Legal description: N1/2 SW1/4 and SW1/4 SW1/4 of 21-2S-14E of 6th P.M. in Nemaha Co., Ks.

Physical address: Southwest corner of property lies at 160th and U Road

Directions: 10 miles east of Seneca, Ks. on Hwy. 36, 1 mile north on U Road or 7 miles west of Fairview, Ks. on Hwy. 36, 1 mile north on U Rd.

Bids must be at law office by April 30, 2014 @ 4:00 p.m. Bids will be opened May 1, 2014. Seller reserves the right to invite 2 or more parties to a private auction after opening the bids. Seller reserves the right to refuse any and/or all bids.

TERMS AND CONDITIONS: Non-refundable down payment of $50,000 to serve as earnest money due upon signing real estate contract. Successful bidder will enter binding contract with balance due in certified funds at closing with possession on or before June 1, 2014. There will be no financing contingency.

2013 taxes and prior years will be paid by Seller. Buyer is responsible for 2014 taxes. 2013 taxes were $320.80

Property is currently under lease for grazing until Sept. 1, 2014. Property will be sold subject to the terms of the lease agreement. Lease agreement available upon request.  Buyer will receive total lease payment of $4800.00

Mineral rights will be retained by Seller for a 10 year period or as long as any production occurs. Rights will transfer to Buyer after 10 years if there is no production.

GENERAL INFORMATION

120 acres in 21-2S-14E of Nemaha Co. Ks.

Subject property lies within the confines of Nemaha-Brown Joint Watershed Dist. #7 and may be subject to future restrictions and/or assessments as a result thereof.

Subject property lies within Pesticide Management Area and is restricted as to the use of atrazine.

Subject to Easement in favor of Southwestern Bell Telephone Co., its successors and assigns.

2013 TAXES: $320.80

Seller responsible for 2013 taxes and previous years. Buyer will pay all of 2014 taxes.

Land is currently all in brome and mixed grasses, but approx. 90 acres are tillable. Property has NOT been enrolled in the USDA farm program for many years.

There is a good stock pond and a serviceable working well on the property. Also, there is a set of cattle holding pens and a 26’x 52’ cattle shed in fair condition near the southwest corner of the property. Any portable gates and chutes on the property do not transfer as they are personal property to be used in gathering cattle on grazing lease.

Rural Water District #3 line runs along the west side of U Road.  Electric service is on the property provided by Nemaha-Marshal Electric Coop.

Great deer and turkey hunting potential with the timberland in the northeast corner of the property. New fence along U Road, other fences in good to fair condition.
